Delta State High Court sitting in Bomadi has set aside, annulled and cancelled the announcement of the dissolution of the Executive Council of the Okpokunou Urban Community, in Burutu Local Government Area.
The Court in it ruling by Justice A. J. Edun, declared the said announcement made in the Radio House of the community on 20th December, 2020 or any other date, null and void, as it was in violation of the interim order of the court made on 16th December, 2020.
It also set aside, annulled and cancelled the actions and activities carried out by the Defendants/Respondents, Andrew Jesu and 14 others, between 16th and 23rd December, 2020, in defiance of the interim order of injunction made on 16th December, 2020.
Justice Edun said the ruling was by virtue of Order 6 sub session 6 of the Constitution of Federal Republic of Nigeria, 1999, and Order 38, Rules 1 and 2 and Order 39 of the High Court Civil Procedure Rule 2009 of Delta State and the authorities cited in the case.
The Claimants/Respondents, Hon Kelvin Kabukeme and two others had, in a motion dated 5th January, 2021, prayed the court for an order setting aside and/or annulling and/or cancelling and/or abrogating and/or otherwise declaring completely null and void, the announcement of the dissolution of the Executive Council of the Okpokunou Urban Community in the Radio House of the Okpokunou Urban Community on 20th December, 2020, in violation of the interim order of the court made on 16th December, 2020.
